California Tax Credits Now Available to Married Couples Filing Separately

California tax credits have been expanded to include households married but filing separately – what you need to know.

Prior to 2022, tax credits like the California Earned Income Tax Credit (CalEITC) and Young Child Tax Credit (YCTC) were only available to tax filers who filed single or married jointly. On March 21, 2022 the Franchise Tax Board announced that they would widen this eligibility to those filing married separately.

Franchise Tax Board envisions this would open these tax credits up to about 10,000 filers. These filers have the opportunity to earn up to $3,160 through the CalEITC and $1,000 through the YCTC.

What if you are newly eligible, but already filed your 2021 taxes?

Community members that already filed married separately, qualify for the CalEITC and already did their taxes can do one of the following to capture their credits.

  • File a superseded return prior to the April 18, 2022 due date
  • Wait for a letter from FTB for instructions
  • File an amended return
